What is mediation?

Instead of a judge deciding for you, mediation allows you to create your own outcomes in a structured, supportive environment.

Is mediation legally binding?

The mediation session itself is not legally binding. However, once you reach agreements, they are documented in a Memorandum of Understanding (MOU). Your attorney then converts the MOU into the formal legal document required by the court. After the judge approves it, your mediated agreement becomes a legally binding court order.

What is a Memorandum of Understanding (MOU)?

An MOU is a written summary of the agreements reached during mediation. It is drafted by Grace by BBT™ in clear, neutral language. How long does mediation take?

Most cases resolve within 1–3 sessions, depending on complexity and communication needs. Mediation is significantly faster than traditional court proceedings.

Is mediation confidential?

Yes. Mediation is private and confidential. Discussions, drafts, and notes cannot be used in court unless required by law.

What if one person is overwhelmed, emotional, or struggling during mediation?

Grace by BBT™ uses a trauma‑informed approach. If a participant appears overwhelmed, we pause, check in, and ensure emotional safety before continuing. Mediation works best when everyone feels grounded and supported. If needed, we may recommend outside support or adjust the pace of sessions.

At the end of your mediation sessions, Grace by BBT™ prepares a Memorandum of Understanding (MOU). This document summarizes the agreements you reached during mediation in clear, neutral language. The MOU is not a court order yet — but it is the foundation for one.

How the MOU Becomes Legally Binding

  1. Mediation Sessions Are Completed You and the other party work together to reach voluntary agreements in a private, guided, trauma‑informed environment.

  2. Grace by BBT™ Drafts Your MOU The MOU outlines all agreements reached during mediation, including parenting schedules, communication expectations, decision‑making plans, or other arrangements.

  3. Your Attorney Reviews the MOU You provide the MOU to your attorney. The attorney reviews it, ensures it aligns with legal requirements, and prepares the formal legal document needed for court.

  4. Your Attorney Files It with the Court The attorney submits the finalized agreement to the court for judicial review.

  5. The Judge Approves the Agreement Once approved; the agreement becomes a legally binding court order. This means your mediated agreement is enforceable just like any other court decision.
